Terms of Service

These Terms govern your use of the Maestro Business Advantage website (https://maestrobusinessadvantage.co.za) and the services offered through it (the "Services"). By creating an account, subscribing to a membership, listing your business, buying leads or otherwise using the site, you agree to these Terms. These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECTA) and the Protection of Personal Information Act 4 of 2013 (POPIA).

1. Who we are

The Services are operated by Maestro Business Advantage ("Maestro", "we", "us"). Contact: info@maestroassist.co.za, 015 023 2924, Johannesburg, South Africa.

2. What we offer

  • Business Advantage membership (R299/month) and Business Partner membership (R499/month) — HR, labour, tax, compliance and financial support consultations, templates, reminders and training as described on our Pricing and Benefits pages.
  • Verified Business listing (from R149/month) — a public profile in our directory, quote inbox, reviews and verification badges.
  • Leads marketplace — the ability to post a job/request or to unlock buyer leads using credits.
  • Quotes & reviews — tools for members of the public to request quotes and leave reviews on listed businesses.

Consultation and service allowances (e.g. 3 or 6 per year) are as stated on the plan you select and reset on your annual renewal date. Unused allowances do not roll over.

3. Accounts

  • You must provide accurate information and keep your login credentials confidential.
  • You are responsible for all activity under your account.
  • We may suspend or close accounts that breach these Terms, post unlawful content, submit fraudulent verification documents or misuse the leads marketplace.

4. Payments

  • Fees are shown in South African Rand (ZAR) and are inclusive of VAT where applicable.
  • Recurring memberships and listings are billed monthly in advance via PayFast until you cancel.
  • Lead credits are once-off purchases and are consumed as you unlock leads.
  • Failed payments may result in features being paused until payment is up to date.

5. Cancellations & refunds

You can cancel at any time from your dashboard. Cancellation stops future billing; it does not automatically refund the current period. Refunds are governed by our Refund Policy, which reflects your rights under the CPA and ECTA.

6. Content you post

  • You retain ownership of the content you upload (business profiles, logos, photos, service descriptions, reviews, quote requests, lead posts).
  • You grant Maestro a non-exclusive licence to host, display and distribute that content solely to operate and promote the Services.
  • You warrant that your content is accurate, lawful, not defamatory, and that you have the rights to post it.
  • We may remove content that is unlawful, misleading, unsafe or breaches these Terms.

7. Verification badges

Verification badges (CIPC, Tax, B-BBEE, Insurance) indicate that we received and reviewed the documents you supplied at a point in time. They are not a warranty of ongoing compliance, solvency or quality. Users should conduct their own due diligence before transacting.

8. Reviews & quotes

  • Reviews must be based on genuine experience. Fake, incentivised or defamatory reviews will be removed.
  • Businesses may respond to reviews but may not intimidate or retaliate against reviewers.
  • Quote requests submitted through the site are shared with the relevant business only. Maestro is not a party to any contract that results.

9. Leads marketplace

  • Buyers post genuine requirements. Sellers unlock leads at their own risk — credits used to unlock a lead are non-refundable except where the lead is proven fraudulent or duplicate (see Refund Policy).
  • Maestro does not guarantee that a lead will convert into paying work.

10. Consultations & advice

Consultations and templates are provided by qualified practitioners for general guidance. They do not replace formal legal, tax, audit or accounting opinions on your specific matter. You remain responsible for decisions taken in your business.

11. Third-party services

We use trusted processors to run the Services, including PayFast (payments), Supabase (hosting, database and authentication) and email delivery providers. Their handling of your personal information is covered in our Privacy Policy and Data Processing Addendum.

12. Acceptable use

You may not use the Services to:

  • Break South African law or infringe another person's rights.
  • Scrape, resell, or bulk-extract directory or lead data.
  • Upload malware, attempt to bypass access controls, or interfere with the platform.
  • Impersonate a business you do not represent.

13. Liability

To the maximum extent permitted by law (and subject to sections 48–52 of the CPA and section 43 of ECTA), Maestro's total liability arising from your use of the Services is limited to the fees you paid us in the three (3) months preceding the event giving rise to the claim. We are not liable for indirect, incidental or consequential loss, loss of profits, or loss of data. Nothing in these Terms limits liability that cannot lawfully be limited.

14. Suspension & termination

We may suspend or terminate the Services (in whole or for a specific user) if you materially breach these Terms, fail to pay, or use the Services unlawfully. On termination, your public listing, dashboards and non-essential data will be deactivated. Some data may be retained as required by law (see the Privacy Policy).

15. Changes

We may update these Terms from time to time. Material changes will be communicated by email or through the dashboard at least 14 days before they take effect. Continued use after the effective date means you accept the changes.

16. Dispute resolution

If you have a complaint, contact us first at info@maestroassist.co.za. If we can't resolve it, you may refer the dispute to the National Consumer Commission, the Consumer Goods and Services Ombud, or a competent South African court. These Terms are governed by South African law and subject to the non-exclusive jurisdiction of the South African courts.
